Foolem — Terms of Service

Welcome to Foolem. These Terms of Service ("Terms") govern your use of the Foolem service available at foolem.app and related domains (the "Service"). Please read them carefully.

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.


1. Who operates Foolem

Foolem is currently operated by Eik Bidstrup, an individual based in Copenhagen, Denmark, operating under the trade name "Havnia" (a planned business entity in the process of being formalised).

The operating entity may change as Havnia is formally registered. Users will be notified of any change in the operating entity through these Terms.

2. What Foolem is

Foolem is a multiplayer browser-based party game. Players join rooms together and play voice or video-based challenges. The Service is currently provided free of charge.

Foolem may, in the future, introduce optional paid features (such as audio packs or cosmetic add-ons). When that happens, additional terms specific to those purchases will apply, and users will be notified before any charges occur.


3. Eligibility and age requirements

General use

You must be at least 13 years old to use Foolem. If you are under 16 and located in the European Union, you confirm that you have permission from a parent or legal guardian to use the Service, as required by the EU General Data Protection Regulation (GDPR).

Dare mode and video features

Foolem's "Dare mode" allows users to record and share short video clips with other players in their room. Dare mode (and any mode that includes video) is restricted to users who are 18 years of age or older.

By using Dare mode or any video feature on Foolem, you confirm that you are at least 18 years old. We rely on this confirmation in good faith. Providing a false age is a breach of these Terms and may result in immediate removal from the Service.


4. Accounts and access

Foolem currently allows players to join rooms anonymously without creating an account. You access rooms via invite codes shared by other players.

You agree not to:

  • Share invite codes with people you do not know or trust
  • Attempt to guess, brute-force, or otherwise gain unauthorised access to rooms you have not been invited to
  • Impersonate other users, real people, or organisations
  • Use automated tools, bots, or scripts to access the Service

5. User content and recordings

What you upload

When you play Foolem, you may create voice recordings (in any mode) and video recordings (in Dare mode). These recordings are stored on Foolem's servers temporarily to enable gameplay.

Retention

Recordings are automatically deleted from our servers after a short retention period:

  • Voice recordings: up to 48 hours after creation
  • Video recordings: up to 24 hours after creation

Recordings that have been reported by another user may be retained longer for moderation review and, where applicable, evidence preservation.

Licence to use your content

By uploading recordings to Foolem, you grant Foolem a non-exclusive, royalty-free, time-limited licence to host, transmit, and play back your recordings to other players in your room, solely for the purpose of operating the Service. This licence ends when the recording is deleted from our servers.

You retain all ownership rights to your content.

Your responsibility

You are solely responsible for the content you upload. You agree that your recordings will not:

  • Contain sexual or sexually explicit material
  • Contain content depicting, sexualising, or endangering minors (strictly prohibited and will be reported to authorities)
  • Contain graphic violence, gore, or content that promotes self-harm
  • Harass, threaten, defame, or impersonate any person
  • Infringe on the intellectual property rights of others (including music, video, or images you do not have rights to use)
  • Promote illegal activity, hate speech, or terrorism
  • Contain personal information of others (real names, addresses, phone numbers, etc.) without their consent

Violation of these rules may result in immediate removal of your content, banning from rooms, and where applicable, reporting to law enforcement.


6. Dare mode safety and assumption of risk

Foolem provides a platform for players to create, choose, and perform challenges ("dares") for one another. Foolem does not generate, write, endorse, review, or vet dare content. Dares are created and chosen entirely by users and reflect those users' choices, not Foolem's.

You decide what is safe

  • You are solely responsible for evaluating any dare before attempting it. Only you can judge whether a dare is safe for you, for the people around you, and for your surroundings.
  • You are never obligated to perform a dare. If a dare seems unsafe, illegal, uncomfortable, or beyond your limits, decline or skip it. No game outcome or score is worth risking your safety.
  • Do not attempt any dare that could endanger you or anyone else — including, without limitation, anything physically dangerous or reckless, anything that risks injury or property damage, and anything illegal or harmful.

Assumption of risk

  • If you choose to perform a dare, you do so entirely at your own risk and accept full responsibility for the consequences.
  • Because Foolem does not create or control dare content and cannot supervise how dares are performed, Foolem and its operators are not liable for any injury, death, property damage, legal consequences, or other harm arising from attempting, performing, or being present during a dare — whether that harm is to you or to any other person.
  • This expressly includes bystanders, witnesses, and anyone else affected by a dare attempt. If you perform a dare, you are responsible for the safety of the people and property around you.

Age, content, and enforcement

  • Dare mode is restricted to users who are 18 years of age or older (see Section 3). Do not use Dare mode if you are under 18.
  • Foolem reserves the right to remove any content that promotes, encourages, or instructs unsafe, dangerous, or illegal behaviour, and to ban users who create or perform it (see Sections 5 and 7).

Nothing in this section limits any liability that cannot be excluded under applicable law (see Section 13).


7. Reporting and moderation

Foolem provides a reporting mechanism for users to flag content they believe violates these Terms. Reported content is reviewed by Foolem operators and may be removed, retained for evidence, or escalated to law enforcement as appropriate.

For content involving the sexual exploitation of minors (CSAM), Foolem will:

  • Preserve the content as evidence
  • Report to the National Center for Missing & Exploited Children (NCMEC) in the United States
  • Report to Save the Children Denmark and Danish law enforcement (NC3)
  • Permanently ban the uploader

We aim to respond to reports within 24 hours where reasonably possible. Foolem is currently operated by a small team, so response times for non-urgent reports may be longer. Reports concerning illegal content involving minors are treated as the highest priority.


8. Intellectual property and copyright (DMCA-equivalent)

Foolem respects intellectual property rights. If you believe content on Foolem infringes your copyright, please send a notice to contact@foolem.app containing:

  • A description of the copyrighted work
  • A description of where the infringing material is located on Foolem (room code, time, recording details)
  • Your contact information
  • A statement that you have a good-faith belief that the use is not authorised
  • A statement that the information is accurate and that you are authorised to act on behalf of the copyright owner
  • Your physical or electronic signature

We will respond to valid notices promptly and may remove infringing content.

Because recordings on Foolem auto-delete within 24-48 hours, many infringement concerns resolve automatically.


9. Privacy

Your use of Foolem is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights regarding that data.


10. Service availability and changes

Foolem is currently in active development. We may:

  • Add, change, or remove features at any time
  • Update these Terms with notice posted on foolem.app
  • Suspend or discontinue the Service temporarily or permanently

We will make reasonable efforts to provide advance notice of significant changes, but we cannot guarantee uninterrupted access.


11. Termination

You may stop using Foolem at any time.

We may suspend or terminate your access to the Service if you violate these Terms, particularly the content rules in Section 5. We may also block specific IP addresses or invite codes from accessing the Service to prevent abuse.


12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Recordings will be retained for any specific period before automatic deletion
  • The Service will meet your specific requirements
  • Any defects in the Service will be corrected

To the maximum extent permitted by law, all such warranties are disclaimed.

This disclaimer does not affect your statutory rights as a consumer under Danish or EU law, which cannot be waived by contract.


13. Limitation of liability

To the maximum extent permitted by applicable law, Foolem and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or recordings
  • Loss of profits, revenue, or business opportunity
  • Damages resulting from another user's content or conduct
  • Damages resulting from unauthorised access to invite codes or rooms

Our total cumulative liability to any user shall not exceed €100 EUR, or the amount the user has paid Foolem in the past 12 months, whichever is greater.

This limitation does not apply to:

  • Damages caused by our gross negligence or wilful misconduct
  • Liability that cannot be excluded under applicable law (including, where applicable, mandatory consumer protection rules)

14. Indemnification

You agree to indemnify and hold harmless Foolem, its operators, and its sub-processors (Vercel, Supabase, and Daily.co) from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Service, except where such claims arise from our own gross negligence or wilful misconduct.


15. Governing law and dispute resolution

These Terms are governed by the laws of Denmark, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Denmark.

If you are a consumer residing in the European Union, this choice of jurisdiction does not deprive you of the protections of mandatory consumer law in your country of residence. You may also be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.


16. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through a notice on foolem.app at least 14 days before they take effect, where reasonably possible. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
